EU simplifies hemp crop controls while broader agricultural policy changes take shape

The European Union has adopted new rules that ease administrative requirements for industrial hemp growers while negotiations continue over broader agricultural reforms that could have much wider implications for the crop.

The developments are separate. One is an administrative regulation that has already entered into force, while the other involves broader reforms to EU farm policy that remain under negotiation.

Inspection rules

Under a regulation change, EU member states have gained greater flexibility in carrying out hemp controls under the Common Agricultural Policy (CAP). The rule gives national authorities more flexibility in scheduling hemp compliance checks and reduces mandatory inspection requirements. That change was made after the European Commission concluded that existing procedures could be simplified without reducing the reliability of THC compliance checks.

For growers, the changes should mean fewer administrative hurdles. National authorities will have more flexibility in enforcing certified-seed and THC-testing rules, while the basic requirements for CAP farm subsidies remain unchanged.

Council talks

Separately, officials in the Council of the European Union continue negotiating amendments to the Common Market Organisation (CMO) regulation covering agricultural markets. The proposals extend far beyond hemp, addressing marketing standards, sectoral interventions, import duties and other agricultural provisions, but hemp is among the subjects under discussion.

The impact of those potential changes on hemp will depend on negotiations among the Council, European Parliament and European Commission before any final legislation is approved.

The Council negotiations follow a separate European Parliament initiative that would expand CAP support to hemp flowers by recognizing them as agricultural products eligible for farm subsidies. That proposal remains part of the legislative process and is not yet EU law.
